In order to optimize the city development, the municipal land-use plan needs to be directed in the municipal spatial plan consisting of spatial structure and pattern. Article 11 paragraph (2) of the Law No. 26/2007 on Spatial Plan states that a municipality has the authority to the implementation of its spatial plan, including the municipal spatial plan, land-use plan and land-use control. Abstract

Abdul Rahim Lubis The role and liability of the Notary are to ensure whether the call for the RUPS (General Meeting of the Shareholders) is made which is in line with Article 82 of the Law on Limited Company, includes the agenda of the RUPS, ensures that the stakeholders attending the meeting matches the most recent list of the shareholders, makes minutes of the meeting and is responsible for the application of the addendum of the article of association to the Minister. The obstructions are caused by some factors such as the limited company incomplete data, management, application cost, unregistered addendum of the article of association, unsuitable data, Notary’s negligence and weakness in the laws. Moreover, the legal consequences to the Limited Company for its late application of the addendum of the articles of association to the Minister or that the addendum has not been recorded in the Limited Company List run by the Ministry of Law and Human Rights is that the Ministry can refuse all applications for then addendum. Consequently, it will cause difficulty for the limited company when it needs some credit from the bank because the bank will require a memorandum of association or its last addendum of articles of association.Keywords: Limited Company, Notary, Application of Addendum of Articles of Association to the Minister.

KEIZERINA DEVI A   Basically, each birth should be reported to the related Agency at least 60 (sixty) days since the birth and the registration which exceeds 1 (one) year deadline should be carried out according to the Court's Verdict as stipukated in Article 32, paragraphs 1, 2, and 3 of Law No. 23/2006 on Aminduk (Population Administration). There is a problem in Article 32 of Law on Aminduk so that it has to be judicial reviewed, and now it is considered legally invalid.The objective of the research is to find out 1) the implementation of makinng birth certificates according to Law No. 23/2006 on Aminduk and the Constitutional Court's Ruling No. 18/PUU-XI/2013 at the Dukcapil (Civil Registry and Population) Office of Medan, 2) the consequence of the Constitutional Court's Ruling No. 18/PUU-2013 on protoviding birth certificates which exceed the deadline in the pre and post the Constitutional Court's Ruling No. 18/PUU-XI/2013 at the Dukcapil Office of Medan, and 3) the obstacles faced by the Dukcapil Office of Medan in providing certificates which exceed the deadline in the post Constitutonal Court's Ruling No. 18/PUU/XI/2013 and the efforts to handle the obstacles. The research used field research method in which primary data were obtained directly from the employees of the Dukcapil Office in providing childbirth certificates.Keywords: Birth Registration, Deadline, Pre and Post, Constitutional Court's Ruling

Utary Maharany Barus PPJB-TB is a preliminary agreement on land and building right transfer between the seller and the buyer before the real Purchase Contract is signed. The issuance of PP No.34/2016 causes legal certainty in which PPJB-TB, PPh-Final payable, and the implementation of tax assessment on PPh in PPJB become the responsibility of a Notary. PPh-Final payable in PP No.34/2016 has met the principle of justice since it belongs to a person who has additional income from land and building right transfer or to those who transfer their land and building through PPJB and/or its addendum. Concerning settled PPJB-TB, related to its tax, the implementation of Settled PPJB-TB does not become the object of BPHTB and its exception so that there is legal uncertainty for PPJB as the object and is regulated on BPHTB in Law No.28/2009 on Regional Tax and Retribution and in the regulation on PPh in PP No.34/2016.

KEIZERINA DEVI A   The notary acting as an intermediary relating to the sale and purchase ofland violates the provisions of UUJN, Oath of Notary Public, and Notary Code ofConduct, for violating the principle of impartiality which may affect the honorand dignity of the notary. From that case the Regional Board should report to theRegional Honor Board that there has been a violation of the Code of Conductconducted by its members. Furthermore, the Regional Honorary Board shall takeimmediate action by holding a session of the Regional Ethics Council to discussallegations against such violations. Abstract

The problems of allocation of an inheritance will never cease when they are analyzed based on the system of kinship which is practiced either by a certain traditional community or by the community that follows the bonds of matrimony with different kinship such as in interracial marriage. The research used descriptive analytic method which described, explained, and analyzed inheritance system in the intermarriage between a Bataknese and a Minangkabaunese.The result of the research showed that the existence of various kinds of ethnic groups in Indonesia had caused intermarriages with different kinship so that the allocation of inheritance from parents to their children would change. The allocation of inheritance in the community that practices patrilineal system has changed in which the allocation of inheritance in the intermarriage of the patrilineal community usually uses individual inheritance system of the Adat Law although some of them use inheritance system based on the Islamic Law. The allocation of inheritance in the community that practices matrilineal system, although the parties concerned come from matrilineal kinship system, when there is intermarriage, the kinship system is not used. The allocation of inheritance is done according to the agreement of the heirs as what is practiced in the patrilineal system. This system has also been changed in the inheritance allocation system which is done either according to the mutual agreement or to the Islamic Law.Keywords: Inheritance System in Bataknese and Minangkabaunese
